CheerCam User Agreement
Effective 27 September 2026
This agreement is between you and Victor Procure, carrying on business as CheerCam, in Alberta, Canada (“CheerCam”, “we”). By installing or using the CheerCam app you accept it. If you do not accept it, do not use the app. Questions go to support@getcheercam.com.
1. What CheerCam is
Section titled “1. What CheerCam is”CheerCam turns a phone into a camera for amateur sports: it records and live-streams a game with a scoreboard drawn into the picture, keeps replay clips, and can be run from a second phone on the same network. It is a tool for the person operating the camera. You need to be at least 18, or using it under the responsibility of an adult who has accepted this agreement.
2. Your licence
Section titled “2. Your licence”CheerCam grants you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for filming and broadcasting games. You may not copy, modify, reverse engineer, resell or redistribute the app except where the law allows it regardless of this clause. Scoreboard graphics, scenes and other design files bundled with the app are licensed for use inside the app.
3. Your content
Section titled “3. Your content”Everything you film, record, enter or import is yours. CheerCam claims no rights in it and, as the Privacy Policy explains, never receives it unless you stream it to a destination you chose.
You are responsible for your content and for your broadcasts. In particular you are responsible for:
- having the permission of the league, venue, organisers and the people being filmed that the situation requires, especially where minors are involved;
- any music, logos, sponsor material or other third-party material you put into the stream;
- complying with the rules of the place you stream to, such as the YouTube Terms of Service and Community Guidelines, and of any RTMP service you use;
- keeping your stream key private.
You may not use CheerCam to stream or record anything that is unlawful, that infringes someone’s rights, or that harasses or endangers anyone.
4. Third-party services
Section titled “4. Third-party services”Streaming to YouTube uses the YouTube API Services. Signing in to YouTube through CheerCam means you also agree to the YouTube Terms of Service (https://www.youtube.com/t/terms), and Google’s Privacy Policy (https://policies.google.com/privacy) applies to Google’s handling of your account. You can remove CheerCam’s access at https://security.google.com/settings/security/permissions.
YouTube, any RTMP service you enter, the Apple App Store, Google Play and RevenueCat are run by others under their own terms. CheerCam is not responsible for them, for their availability, or for what happens to a stream once it has left your phone.
5. Subscriptions and trials
Section titled “5. Subscriptions and trials”When subscriptions are offered, they are bought through the Apple App Store or Google Play and are governed by that store’s terms, including for payment, renewal, cancellation and refunds. A subscription bought on one store does not carry over to the other. Free trial time is counted on the phone, resets if the app is reinstalled, and is offered at CheerCam’s discretion. Prices and what a subscription includes may change; a change applies from your next renewal.
6. What CheerCam does not promise
Section titled “6. What CheerCam does not promise”CheerCam is provided as it is. Live streaming depends on your phone, your network and the service you stream to, none of which CheerCam controls. A stream can drop, a recording can fail, a phone can overheat or run out of battery, and a clock or score on the overlay can be wrong if it was entered wrong. Record to the phone as well as streaming when a game matters, and check the destination before you go live.
To the extent the law allows, CheerCam gives no warranty of any kind, including that the app will be uninterrupted, error-free or fit for a particular purpose, and CheerCam is not liable for any indirect, incidental or consequential loss, or for any loss of footage, revenue, sponsorship or reputation, arising from the app or a broadcast made with it. Where liability cannot be excluded, it is limited to the amount you paid CheerCam for the app in the twelve months before the claim. Nothing in this agreement limits rights that consumer law gives you and does not allow to be limited.
7. Indemnity
Section titled “7. Indemnity”You will cover CheerCam against claims by others that arise from your content, your broadcasts, or your breach of this agreement, including claims about filming or broadcasting people without the permission the situation required.
8. Ending this agreement
Section titled “8. Ending this agreement”You can end it at any time by uninstalling the app; your subscription, if any, is managed through the store. CheerCam can end your licence if you break this agreement. Sections 3, 6 and 7 continue to apply afterwards.
9. Changes
Section titled “9. Changes”If this agreement changes, the new version ships with the app and the effective date at the top changes. A change that reduces your rights will be pointed out in the app before it applies. Using the app after that is acceptance of the new version.
10. Governing law
Section titled “10. Governing law”This agreement is governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute goes to the courts of Alberta, unless consumer law gives you the right to bring it elsewhere.
11. The whole agreement
Section titled “11. The whole agreement”This agreement and the Privacy Policy are the whole agreement between you and CheerCam about the app. If part of it cannot be enforced, the rest still applies.
